Important notice
FixNear is a marketplace platform and does not provide services directly. We are not responsible for the quality of work performed by listed businesses or tradespeople. Contracts for work are between members and service providers; FixNear facilitates introduction and communication only, except where we explicitly offer a separate paid platform feature governed by its own terms.
1. Agreement
These Terms & Conditions (“Terms”) govern your access to and use of the FixNear marketplace Platform (the “Platform”). By registering, browsing, posting content, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Platform.
References to “FixNear”, “we”, “us”, or “our” mean the legal entity operating the Platform. References to “you” include any visitor or registered user.
2. The Platform is a marketplace
FixNear provides an online venue that connects members who need work with tradespeople and businesses who offer services. We are not the employer of service providers and not a party to contracts for physical work, materials, or on-site services between users, except where we expressly provide a separate platform service with its own terms.
You are responsible for evaluating whom you engage, for agreeing price, scope, timing, insurance, and compliance with law, and for performing your own checks (including qualifications and references) before committing to work.
3. Definitions
- Member — a user posting or managing service requests or related activity as a customer or household representative.
- Tradesperson / business — a user offering services through a profile, company listing, or quote.
- Content — text, images, reviews, messages, listings, and other material submitted to the Platform.
4. Eligibility and accounts
You must be at least 18 years old and capable of entering a binding contract. You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your password and for all activity under your account. Notify us promptly of any unauthorised use.
5. No guarantee of service quality or outcomes
We do not guarantee that you will find a suitable tradesperson, that quotes will be received, that work will be completed, or that any particular outcome will be achieved. Profiles, reviews, and badges are informational only and do not constitute a warranty from FixNear about skill, fitness for purpose, or suitability for your job.
6. Jobs, listings, quotes, and messages
- Listings and requests must be lawful, honest, and sufficiently clear for providers to understand the work.
- Quotes and offers should reflect genuine intentions; repeated low-quality or misleading offers may be restricted.
- Messaging must remain respectful and relevant to the prospective engagement. Attempts to manipulate the marketplace (for example fake urgency or bait-and-switch pricing) are prohibited.
- You remain responsible for agreements you make off-platform as well as on-platform; however, circumvention designed to evade legitimate platform fees or safety processes may breach these Terms.
7. Prohibited activities
You must not:
- post spam, pyramid schemes, or unsolicited bulk promotional content;
- create fake listings, fake businesses, or impersonate another person or organisation;
- submit or solicit fake, incentivised, or defamatory reviews, or review your own business through alternate accounts;
- harass, threaten, discriminate unlawfully, or post illegal, obscene, or infringing content;
- scrape, data-mine, or overload the Platform; reverse engineer where prohibited by law; or attempt unauthorised access;
- use the Platform for any illegal purpose or in breach of applicable trade, tax, or consumer regulations.
8. Content and intellectual property
You retain ownership of Content you submit, but you grant FixNear a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, adapt, and distribute that Content on and in connection with operating, promoting, and improving the Platform, subject to our Privacy Policy.
The FixNear name, logo, and Platform software and design are protected. You must not use our branding in a way that suggests endorsement of your services without written permission.
9. Moderation, suspension, and termination
We may investigate reports and may remove Content, restrict features, suspend, or terminate accounts where we reasonably believe these Terms, our community rules, or applicable law have been breached, or where necessary to protect users or the integrity of the Platform. We may give notice where appropriate, but urgent cases (such as fraud or safety risks) may be acted on without prior warning.
You may close your account through available account tools or by contacting support. Provisions that by their nature should survive (including disclaimers, limitations of liability, and governing law) will survive termination.
10. Fees
Certain features may be subject to fees or subscriptions as displayed at the point of purchase. Unless stated otherwise, fees are exclusive of VAT where VAT applies. Payment processing is subject to the relevant provider’s terms.
11. Disputes between users
Disputes relating to workmanship, payment for labour or materials, cancellations, or damage are primarily between the member and the service provider. FixNear may, at its discretion, offer informal assistance or internal processes, but is under no obligation to mediate, arbitrate, or enforce private agreements between users.
12. Limitation of liability
To the fullest extent permitted by applicable law, FixNear shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities, arising out of or in connection with your use of the Platform or any services arranged through it.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under English law, including death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability which cannot be limited.
Subject to the preceding paragraph, our total aggregate liability arising out of or in connection with the Platform in any twelve-month period is limited to the greater of (a) one hundred pounds sterling (£100) and (b) the total platform fees you actually paid to FixNear in that period (if any).
13. Indemnity
You agree to indemnify and hold harmless FixNear and its officers, directors, employees, and agents from claims, damages, losses, and reasonable legal costs arising from your Content, your breach of these Terms, or your misuse of the Platform, except to the extent caused by our wilful misconduct.
14. Changes to the Platform and Terms
We may modify the Platform or these Terms. We will post updated Terms and revise the “Last updated” date. Where changes are material, we may provide additional notice (such as an on-site message or email). Continued use after changes become effective constitutes acceptance of the revised Terms, where permitted by law.
15. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, subject to any mandatory rights you may have as a consumer in your home jurisdiction.
16. Contact
For questions about these Terms, please contact us via our Support page or the contact details shown in the Platform footer.
